Contact Management Series by Jennifer Allan-Hagedorn - Part 3: "But I Can't Afford a Contact Management System!"

At one point or another in their careers, most real estate agents consider purchasing a contact management system to help them manage their businesses. It can be an overwhelming decision – so many to choose from, offered in various platforms and formats all promising the world in features and benefits. And these features and benefits come at a cost, of course – that cost ranging from $10/month to $35/month to $90/month, or, for desktop-based versions, a one-time charge of $300 or more plus annual upgrades.

This can be a sticking point for many agents, especially those who are struggling. I hear it all the time – “But I can’t afford $35/month for a contact management system!”

$35/month.

Yes, times are tough. Budgets are tight. Every dollar coming into the household (or not, as the case may be) must be accounted for and spent wisely. I understand that and frankly, I’m impressed with agents who don’t just jump on a bandwagon to spend spend spend just ‘cause someone told them they should.

BUT

Two things.

First, you should never purchase a system, tool or program that you don’t believe will not cover its cost, either in hard dollars or by saving you time (with which you can go out and earn some hard dollars). I will never recommend that you purchase anything for your business that won't, at the very least, pay for itself (assuming you use it), with the goal, of course, being that it pays for itself many times over.

Second (brace yourself, this might sting a little), you are in business for yourself. You are self-employed. You made the leap of faith into selling real estate knowing (hopefully) that you would no longer be protected by that regular-salaried, benefits-included, vacations-paid J  O  B you left. Selling real estate professionally is not a hobby. It's not (hopefully) a side gig that you do because you have a little spare time. It's your career; it's your profession. And it's up to YOU and YOU only to invest in the tools you need to be successful. And if you're at the point where $35/month breaks the budget, it might be time to re-evaluate whether or not you're doing the right thing by you and your family by being self-employed at this time.

That said, if you spend $35/month for a contact management system, will you automatically be successful? No, of course not.  Especially if you don't use it! Do you HAVE to have Contact Management to survive as a real estate agent? Again, no, not at all. But if you bite the bullet and invest in yourself and your business by committing to a good contact management system, it will change your professional life.

In Part 1 we discussed the types of services performed by commercial real estate professionals. In Part 2 we will look at specific tasks a commercial real estate broker can expect to perform.

Commercial Real Estate is an exciting and rewarding field of study and can lead to dozens of different career opportunities. Whether someone is starting their first small business, developing a parcel of land, or considering an investment in real estate rather than an investment in a mutual fund or money market, the understanding of commercial real estate is fundamental to their decisions.

To begin your career in this sector of the industry you’ll need to understand exactly what you’re selling, how it is priced, how it is financed and what legal documents must be used to convey the sale or lease. Let's begin introducing you to the key elements necessary to be successful in commercial real estate.

You will need to examine the diverse forms that commercial property takes and the important terms used by those in the field to explain and understand a type of property. Next you will need to explore the different methods of determining value in the eyes of property users, investors, real estate professionals and appraisers. You will also need to learn how commercial real estate can be financed and how it may be leased. There is also a need to perform an examination of the legal documents including listing contracts, sales agreements and lease contracts.

Your responsibilities as a commercial real estate professional include:

For Sellers or Property Owners:

• Hold or Sell Analysis – Analyze the market to determine what course of action is best for a property owner. Is it better to hold onto the property longer, or would an owner be better suited selling the commercial property? This analysis may   include projections of cash flows, and determination of internal rate of return.  
• Property Management– Assist the owner by leasing and / or managing the day to day situations that arise in any real estate investment.  Management may include suggestions of how to create more value in the property. 3 story multi-tenant Office Building with central common atrium.  
• Property Leasing – Finding tenants for a property owner’s commercial real estate. This may include advice on creating a niche for the property, or ways to attract more solid long term tenants.  
• Property Sale or Marketing – Determining the best course of action in order to maximize the sales price on a property and find the best possible buyer.

For Buyers, Tenants or Investors:

• Investment Analysis – Provide an investor or buyer with comparisons of various properties or types of property and their cash flows or investment returns in order to determine what situation may be best for the investor or buyer.  
• Site Selection – Assist the investor or buyer with locating a site that meets the client’s needs. Assist with demographic data to support the client’s business or investment goals. An agent may also be required to assist with determining the site’s suitability based on zoning regulations, environmental conditions and financing considerations.  
• Cash Flow Analysis / Return on Investment – What kind of return can an investor expect on a particular real estate investment? Agents provide projections of potential future income and analysis of potential return on the property.  

For both Sellers / Owners and Buyers / Investors:

• Property or Business Valuations – Any property owner wants to know what their property is worth to a buyer and what the highest sales price or lease price is possible in the current market. Buyers or Investors want to know what a fair price may be for the same property or business, and will want to know what the best investment may be at this point in time.
• Feasibility Studies – Conduct a market study with the help of Real Estate Appraisers and engineers to determine the highest and best use of a property, or forecast a project’s likelihood of success.
• Exchange Opportunities – Tax-deferral benefits may make it worthwhile to exchange the property, or use a 1031 deferred exchange.

Part 1 of 2: Becoming a Commercial Real Estate Broker

The Commercial Real Estate Industry touches virtually every aspect of business in the United States and most of the free world. Very few companies can grow without acquiring more land or additional office space, patients can’t use the services of a hospital unless it’s constructed and consumers can’t shop at a Wal-Mart without the development of Real Property.

Commercial Real Estate encompasses all aspects of sales, leasing, management, investment in or improvement of retail property, investment property, farmland, businesses, industries, medical facilities and dozens of other types of property. Our job in the industry is to assist in the lease, management or sales of property, and to advise our clients of their best courses of action when deciding how to invest in or improve real property or a commercial asset.

You will work directly with industry leaders, community leaders, government officials, lawyers, zoning officers, accountants, mortgage companies, banks, title companies, appraisers, utility companies and everyone in between to put together sales or develop property to its full potential for a client. While you can’t make decisions for our clients, you can assist them in making better informed decisions, and you can help our clients to understand what the highest and best use may be for a particular property, or what type of investment vehicle might be best for your client.

You will work with property owners who may want to sell a property, lease a property, have a property managed or determine what use might be better for the property than the current use. You will work with users of properties to find the best location for their business or investment, to determine if it’s better for the user to lease a property or purchase and to understand the tax implications of their decisions. Additionally, You will work with investors to determine which real estate venture might be their best investment to meet their particular goals and needs.

Commercial real estate agents and brokers work with individuals, investors, organizations and corporations to develop property to its highest potential. Their careers include many specializations. Some commercial associates specialize in particular types of property, such as office property, develop-able farmland or even amusement parks. Other commercial associates specialize in particular forms of consulting work for Real Estate Investment Trusts (REITs), insurance companies or utility companies. Still others work in specialized areas such as resort management or assist government agencies with the redevelopment of industrial sites or reclamation of land.

Colorado Real Estate Commission approves Position Statement on "Coming Soon" (pocket) Listings

At the most recent Colorado Real Estate Commission meeting held on June 3, 2014, the Colorado Real Estate Commission adopted Commission Position CP-44  regarding  advertising properties as "coming soon" to the market.

CP-44 outlines a broker's obligation to exercise reasonable skill and care when advising a seller or landlord of the advantages or disadvantages of different marketing methods.  Further, the manner in which the broker and seller or landlord agree to market the property must be memorialized in writing in the listing contract, prior to any marketing being performed. 

The Commission has received complaints regarding "coming soon" listings, many of which fall into the category of "pocket listings", where the listing broker does not immediately place the property in the MLS in the hopes of double-siding the transaction or under company policy that gives other brokers in the same office the first chance to get their buyers into the property allowing one brokerage firm to double-side the transaction.

The new position statement clarifies that "During the negotiation of the listing contract, and as part of the broker's obligation to exercise reasonable skill and care, a broker is responsible for advising the seller or landlord "of any material benefits or risks of a transaction which are actually known by the broker."

The position statement clarifies that if a listing is being kept off the MLS in order to "double end" the transaction, this would be a violation of license law. The Commission further clarifies that it is the seller or landlord's decision how, when and where the property will be marketed and that any agreement to market the property must be memorialized in writing in the listing contract prior to any marketing being performed.

Our Take is this: Brokers should consider putting a timeline on MLS entry into the listing agreements to clear up any confusion on this topic. The MLS being used should also be specifically listed so that the seller or landlord can identify where online their property will be marketed.

If the licensee will be keeping the property OFF of the MLS for a period of time, then that too should be disclosed in writing in the listing agreement and real estate professionals would be well served to keep good notes in the client file on the discussions that have taken place regarding ANY delay in MLS entry of the clients listing.

Side Note: We advise real estate professionals to include a list of the websites or listing aggregators they use in their listing package for sellers and landlords so that the client can assess those services for themselves and affirmatively approve or deny any services they do not wish to be used in the marketing efforts.

Our Favorite Stories from March: 2014 Housing predictions, key ruling for Property Managers and ... of course ... Zombies.

This month was filled with interesting stories. We've collected a few of our staff favorites and posted them here in brief.

Wind Energy - Twenty Six Senators urged the Senate Finance Committee leadership to Extend wind production tax credits. The credits support 80,000 American workers. A bipartisan coalition of 118 members of the U.S. House sent a similar request to the House Committee on Financial Services.  We were excited by three things in this announcement, including the support of a Green industry that creates jobs for people all over the country and the positive effect the wind industry has on real estate markets, but mostly we were impressed that the support was bipartisan. Really, when does that happen in Congress?

 

Housing in 2014 - Economist David Berson wrote the 3 things you need to know about housing in 2014 for Housingwire. We think his #3 item (Mortgage availability shouldn't worsen and may improve) is a bellweather statement. This leads him to state that is interest rates rise then refinance applications will fall, which should lead lenders to eae lending standards to the extent possible under the new QM rules. A boost in lending activity means a boost to home sales, and that would be good for all of us.

 

Vampires - Vampire Gravesites in Poland? Yep. As reported by Newsy, a vampire grave site seems to have been unearthed. Typically we're more concerned with zombies, but the finding of vampires also raises many questions for us. We have concerns.

 

This month's best Tech item - CNN published the map of underwater cables wiring the internet. The The Washington research firm Telegeography logged the map in its Submarine Cable Map. Find the article by clicking here. The gallery truly is facsinating - if you like tech as much as we do.

 

Key Court Ruling for Property Managers - The city of Farmers Branch, Texas, passed an ordinance requireing potential tenants to prove citizenship, creating the possibility that immigrants could no longer rent property within the city. The ordinance was immediately challenged in court and was never enacted. Earlier this month, Farmers Branch lost a long and expensive court battle when the U.S. Supreme Court refused to hear an appeal of a U.S. Circuit Court of Appeals case. The ruling says two things: First, for real estate professionals, you cannot demand proof of U.S. Citizenship in order to rent property to a prospective tenant. Second, some have suggested that this affirms that Immigration law is the responsibility of the Federal Government, not local municipalities.

The case may have ramifications on another case that is being litigated out of Fremont, Nebraska as well where the Court of Appeals has issued an opposite ruling on a similar ordinance. Read more about the Farmers Branch case in the Dallas News.

 

Dateline: Las Vegas: A man went into the Excalibur hotel and in a failed attempt at burglery was "detained" (possibly "defeated") by the men in the cast of the Thunder Down Under male review. We tried to tweet this but couldn't think of any combination of hashtags that would be ...ya' know... oh, forget it. Just insert your own comment here.

 

Zombies can't get us here! - Turns out Estately was finally able to put some resources into one of the issues we think is most critical: Determining where we need to be when the zombie apocolypse begins. Their list of U.S. States Most and Least likely to survive a Zombie Apocolypse finally hit their blog. Turns out where we are is fairly safe (which we are grateful for) but there are a few states that need to do a better job preparing their citizens for the eventual ... or at least, concievable ... We're afraid of zombies. That is all.

 

Just in Time for Spring - In an article from Wired magazine we learned that the U.S. Mint will releae a 2014 National Baseball Hall of Fame Commemorative Coin that will be unlike any other. In 2012 Congress passed an Act that gave birth to the coin, which will be domed (as in, roundish) to reflect a baseball on one side.
